Texas Same-Sex Marriage & Civil Union Bill
I'm likeing Senator Jeff Wentworth less and less these days. His Senate Bill 7 is an attempt to outlaw legally-recognized homosexual marriages and civil unions.
- Sec. 6.204. RECOGNITION OF SAME-SEX MARRIAGE OR CIVIL UNION.
- (a) In this section, "civil union" means any relationship status other than marriage that:
- (1) is intended as an alternative to marriage or applies primarily to cohabitating persons; and
- (2) grants to the parties of the relationship legal protections, benefits, or responsibilities granted to the spouses of a marriage.
- (1) is intended as an alternative to marriage or applies primarily to cohabitating persons; and
- (b) A marriage between persons of the same sex or a civil union is contrary to the public policy of this state and is void in this state.
- (c) The state or an agency or political subdivision of the state may not give effect to a:
- (1) public act, record, or judicial proceeding that creates, recognizes, or validates a marriage between persons of the same sex or a civil union in this state or in any other jurisdiction; or
- (2) right or claim to any legal protection, benefit, or responsibility asserted as a result of a marriage between persons of the same sex or a civil union in this state or in any other jurisdiction.
- (1) public act, record, or judicial proceeding that creates, recognizes, or validates a marriage between persons of the same sex or a civil union in this state or in any other jurisdiction; or
- SECTION 2. The legislature finds that through the designation of guardians, the appointment of agents, and the use of private contracts persons may adequately and properly appoint guardians and arrange rights relating to hospital visitation, property, and the entitlement to proceeds of life insurance policies without the existence of any legally recognized familial relationship between the persons.
This is from the engrossed version of the bill, which passed the Senate and is now in the House.
I think there are two significant individual rights problems in the Republican Party and one of them is it's general stance on homosexuality. The other is it's stance on drugs. Until these two issues are addressed, the GOP has zero moral authority when preaching about "government intrusion."
UPDATE(2:20pm)
Though there are promising signs from some conservatives, such as Jonah Goldberg's comments here. Notice, though, that he can't quite let go of the drug issue.
Comments
Depriving millions of Gay adults American of the marriages of their choice and the rights that flow from marriage, denies equal protection of the law. They, their families and their friends, together with fair-minded people verywhere, should demand as well as end this monstrous injustice.
Just like a white person marring a black person it took a while, but we eventually passed a law. Besides the only reason we had such stupid laws were only to "maintain white supremany".
