Another Considerable Commitment; Eminent Domain Gone Wrong

Just as I praised Dave Gross for his decision to actually stop funding the government by taking hardship upon himself, I feel obligated to applaud Arthur Bixby and his son Steven Bixby for taking a stand against property theft.

A father and son angered by a state plan to seize some of their land for a highway killed two officers who went to their home, setting off a 13-hour standoff and a "horrendous gunfight," authorities and neighbors said.

The Bixby family had decided that they would defend their land to the death, authorities say.

The gunfight was so fierce that police at one point had to bring in extra ammunition, Stewart said. Agents found suicide notes, anti-American material and items that may relate to militias, Stewart said.

Arthur Bixby and his son, Steven Bixby, 36, were charged with murder in the deaths of the two officers, authorities said Tuesday. Steven Bixby was to be arraigned Tuesday; Arthur Bixby, was still being treated for gunshot wounds.

Arthur Bixby's wife, Rita, was charged with being an accessory to murder, and all three also are charged with conspiracy, officials said.

I deeply regret the loss and injury of life and wish I didn't happen. I don't enjoy deadly force being employed against anyone but the most morally ugly of human beings.

However, as Billy Beck said:

Jeffrey, the AP'ster, cites "authorities" and says, "None of the family members tried to negotiate with officers during the standoff."

Notably, no one offers a reason why the family might even consider that. What did they have to win, and when did they have it? A smaller bite of their property before the bulldozers rolled up? That sort of agreement with idlers who pen-stroke peoples' lives? Well, guess what: those people didn't see the percentage. And every now and then, the idlers -- and the types who take their coin to just do their jobs on the bulldozers -- are going to run into people who really are going to stand their lives, fortunes, and their sacred honor against them.


Indeed. I don't axiomatically hate the police nor do I wish them ill. But I do believe that much of the law they are tasked to enforce is immoral and people should not be compelled to comply with immoral law. That I am unwilling to actually take steps like Mr. Gross, the Bixbys, or even Mr. Beck have doesn't lessen the principle of the matter. I may be a wuss, but the ideas exist outside of me and my movtivations.

Man Cites N.H. Motto When Charged With Police Shooting

A former New Hampshire family involved a dramatic shootout in South Carolina Tuesday cited the state motto as defense for killing two police officers.

Police said the Bixby family engaged in a 13-hour standoff at their home Tuesday when two officers were shot and killed over an apparent land dispute.

"Why'd I do it?" Steven Bixby said in court. "We didn't do it. They started it."

Sources told News9 that the Bixby family was part of an extremist group when they live in Haverhill, N.H., about 20 years ago. South Carolina police said Steven Bixby and his parents had a grudge against the government that led to the standoff.

Prosecutors said Steven Bixby and his father, Arthur Bixby, were the shooters at their Abbville, S.C., home. During a courtroom rant to reporters, Steven Bixby cited New Hampshire's state motto as validation for his actions.

"If we can't be any freer than that in this country, I'd just as soon die," he said. "I'm originally from New Hampshire, where the motto is 'Live free or die.'"

It's sad that this will only further convince the mainstream that ardent property rights defenders are violent and unstable wackos, too "extreme" to be taken seriously. It's not as sad as the destruction that occured, but it sucks nonetheless.

Bixbys unnerved some neighbors; others remember kind gestures

In New Hampshire, Grafton County Sheriff's Capt. Paul Leavitt said Bixby was convicted in 1992 of driving with a revoked license and drunken driving. Two years later, an arrest warrant was issued after Bixby did not contact the state to open a probation case, and for not paying his fine.

Leavitt said investigators who searched for him at the time believed he already had moved to South Carolina. The court renewed the warrant in October of this year, based on the probation violations.

Bixby appealed the revocation, saying in a handwritten affidavit: "I've never seen a state or heard of a state that is quite as crooked as this one. The motto, 'Live Free or Die' is one hell of a joke. The new motto ought to be, 'You'll die trying to live free in New Hampshire.' "

A former neighbor of the Bixbys, Ronnie Corley, said Arthur and Rita Bixby were kind people who even once offered to help him build a house without charge. And he said they would fiercely defend their son.

"Arthur and Rita Bixby, if they liked you, they'd do anything in the world for you," Corley said. "They just didn't want to be pushed around about their property rights."

In the end, they killed people in order to protect their property. I wouldn't have choosen that method, even knowing that in the long run, the government would be taking what it wanted.

Thanks for the opportunity to reply to here, as the Bixby's were a part of our Constitutional Group back in the 1980s at the old Turner's Restaurant in Lee [and over at Frank & Barbara Anderson's "Sherwood Inn" in Epsom where we'd meet every 1st or 2nd Sunday of the month, the house with the big Trojan Horse anti-U.N. sign outside] (see this past Saturday's Manchester, New Hampshire UNION LEADER at www.theunionleader.com , also the WALL STREET JOURNAL for the drawing of her profile and the write up about Barbara, since deceased) but that they branched away from our V.O.C.A.L.S. group that started up afterwards [Victims of a Corrupt American Legal System], Inc. and founded by twenty of us, including myself and three State Representatives that did get a House Bill passed by our President Rep. Roland Hemon of Dover (since deceased too), re: rights to a jury trial in all real estate matters, that MAY be waived, see RSA Ch. 498:5-d Decrees, Amendment of 1996. Here in N.H. we had a similar TAKING by the state of #x feet of the front lawn of Mrs. Candace McMinn's property on Rte. 3A in Hooksett in 199_, she went to Merrimack County Superior Court in Concord and won a jury verdict of over $100,000 BUT that the judge George Manias, since retired, OVERturned it! and gave her a choice of to spend $several thousand in transcript fees to appeal to the Supremes or take about $75,000 or for a loss of $25,000, she chose the latter.

So WHERE was the "due process" FOR the Bixby's? WHY didn't the governor, as the chief executive officer, enforce the LAW, meaning their rights as are supposed to be guaranteed by the Constutution? See my case of State v. Haas in Vol. #134 of the N.H. Reports page #480, 596 A2d 127 (1991) for when I did stun gun the patrolman who was "set up" (so said the jury) by an arrogant C.O.P. (Chief of Police) in a tax sale against me back in the 1980s. The right to use force (and deadly force), against ANY unlawful taking of your property, RSA Ch. 627:8 since amended by case-law restrospectively back to include my case to SUB-mit to ALL officers, no matter how WRONG, BUT as I did in the Sheriff'S Sale against me, THAT is EXACTLY what I did, but now where be my "due process" for them NOT following the rules of the game? R.S.A. 528:16 of NO posting (Judge Richard Gallway wrote: to hell with procedural due process!, to take him to the J.C.C. Judicial Conduct Committee to get this reverse as VOID against his CANONS; and NO RSA Ch. 528:18 Return for "thereupon" 528:19 the rents of $2,000/month since Nov. 1995 have been STOLEN), and per the State v. Fleming case in the Criminal Code's Restitution statute leading to Blackstone's Commentaries and the Holy Bible, the penalty for the state thieves is sevenfold the amount stolen, Proverbs 6:30-31 & Public Law 97-280, 96 Statute 1211 of Oct.4,1982=the Year of The Bible for 1983 and beyond. So, like what we did to King George when he met our many petitions with repeated injuries, our American Revolution brought bloodshed to the tyrants, and so be it to the new tyrants too when people see NO redress as in my Art. 32 Petitions (as they were endorsed by then Rep. You all are stupid extremists with no idea of the truth.
The land that the bixby family owned did not even include the land they were fighting for! the plat at the Abbeville county courthouse in Abbeville South Carolina shows this land was owned by the south Carolina department Of Highways before 1960. The Bixby family Moved to union church road in Abbeville in 1980. I believe in the right to bear arms. I also believe idiotic mitia members with no self restraint, care for others, or common sense should not bear a pocket knife! I was a very dear friend of both officers who died that cold morning from an unsuspecting gunshot from that ratty ass home. I am also a member of the Police Department and believe me the Bixby's did not win the fight. I also want to address the issue of Steven Bixby saying he would rather be dead than to not live free. He took the two officer's lives and hid in the bathroom like a pussy untill South Carolina Officers from the whole state rattled his house with over 3500 rounds of amunition. He came out with his hands up and didn't want to die! Hmm once again I call him a pussy. If you want to believe in something and fight that strongly for it, hold up to your end of the bargain!!!

Apparently we're talking about the opinions of an IGNORANT libertarian anarchist! If you want to get on a soap box about property rights, at least do it in a case where the "property owner" at least owns the property in question. The state had owned the rights to that piece of land since well before the Bixbys had bought land in or even moved to South Carolina.
Do a little research before you sound off!

Hi..I was just doing some reading about Steven Bixby. I never met him but I knew him well. We talked for hours in a NH chatroom, he was a bit off the wall but I would never have taken him for a murderer. He was wrong for killing the two deputies, that I do know. Thus is the reason for him being on death row. Know what burns my butt?? You get on death row for killing cops but one can beat, torture, rape and eventually kill children in this country and get 15 to life. Go figure. Steven got the death penalty for standing up for what he believed and will die for it. "Master Chaos" as he was called on the internet is now waiting to die...I hope we don't see that day anytime soon, don't we have bigger fish to fry?

i have heard of this incident and if it is proven that they did not own the peice of land in question than yes by definition of the law they are guily of murder! however if they did own said peice of land, and the state did take it away with out due process, than the state is by default the guilty party in said case! in these times lets not get to the point of calling anyone who believes in the american RIGHT of property, any kind of insulting name! if it wasnt for some folks who questioned the system we would still be under brititsh rule right now!
i do for one believe in property rights, and if the government decided to strip me of those rights for the gain of another individual or group than the government in that case is in violation of the constitutuion of the united states of america!
and in said event then the government then becomes a null and voided party involed and has no authority what so ever to enforce or authorize anything! also it might be a good idea to destroy the llc or incorporated titles in buissness as any corporation by the definition of an unjust law than has the same rights as a human being and a citizen of this country, yet they have even more rights than we do! have you ever seen a corporation stopped or put in jail for any violation of the law!!!! i say no even enron in all its cheatings is still in opperation, just under a different name! sure they might make some corp exec a fall guy, but the corporation will still hang on as if nothing happened, i say when the corporations rape the law, then the corporation should be torn to peices and hence forth be non existent!!!!!! some may ask why do i bring this up in regards to this case! well its corporations that use their big money to take what the little guy has! these corporations say lets move into this town and the elected swine will then let them do as they please in order to pocket a big chunk of change for themselves! corps will get permits automaticaly pushed through the local permit boards, often without a check being made to see if they are fallowing any codes or standard practices that the little guy would have been subjected to!
even for highways, it is allways the large mega corps that get the contracts, and when they do the corrupt little pigglet politicians and officials will benefit from that financialy!
they do not give to shits about the average everyday american! their main concern is to have that lovely home in the hills, and that bmw/mercedese benz etc. and if your a little guy in the way of thatthey will use all force available to destroy you or remove you from the equation! even if it means sicking either the police on you, or even down right contracting for your death, they will do it!!!!!!! as benjamin franklin said quote " it is the nature of goverments to become corrupt" and as thomas jefferson said quote " it is the duty of all americans to change a corrupt government by one of two means either by the ballot box, or if that dose not work by the cartridge box" end quote
